Terms of Sale

By placing an order you are offering to purchase a product on & subject to the following terms & conditions. All orders are subject to availability & confirmation of the order price.
Dispatch times may vary according to availability & subject to any delays resulting from postal delays or force majeure for which we will not be responsible. In order to contract with madgadgettech.co.uk you must be over 18 years of age & possess a valid credit or debit card issued by a bank acceptable to us. Madgadgettech.co.uk retains the right to refuse any request made by you. If your order is accepted, we will inform you by email & we will confirm the identity of the party, which you have contracted with. This will usually be madgadgettech.co.uk or may in some cases be a third party. Where a contract is made with a third party madgadgettech.co.uk is not acting as either agent or principal & the contract is made between yourself and that third party & will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true & accurate, that you are an authorized user of the credit or debit card used to place your order & that there are sufficient funds to cover the cost of the goods. The cost of foreign products & services may fluctuate. All prices advertised are subject to such changes.

Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement & will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods that you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

Pricing & Availability

Whilst we try to ensure that all details, descriptions & prices that appear on this Website are accurate, errors may occur. If any error discovered in the price of any goods which you have ordered we will inform you of this as soon as possible & give you the option of reconfirming your order at the correct price or cancelling it. In case we are unable to contact you, we will treat the order as cancelled; In addition, if you cancel & you have already paid for the goods, you will receive a full refund. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable & included in the ‘Total Cost’

Payment 

Upon receiving your order, we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been despatched & you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.  Your payment will be processed by PayPal. PayPal protects your financial information with industry-leading security & fraud prevention systems. When you use PayPal, your financial information is not shared with the merchant. Once your payment is complete, you will be emailed a receipt for this transaction. PayPal automatically encrypts your confidential information in transit from your computer to ours using the Secure Sockets Layer protocol (SSL) with an encryption key length of 128-bits (the highest level commercially available). Before you even register or log in to the PayPal site, our server checks that you’re using an approved browser – one that uses SSL 3.0 or higher.

Refund Policy

Customer has the right to cancel their order for a limited time even if the goods aren’t faulty. We offer a refund to customers if they’ve told us within 14 days of receiving their goods that they want to cancel. They have another 14 days to return the goods once they’ve told us. We must refund the customer within 14 days of receiving the goods back. They don’t have to provide a reason. Customer must return the item in the same condition it was received including all the packaging & accessories. Upon receipt of the item a refund will be issued.

Warranty Void, no Return or Refund

Please note use of any means to bypass the payment to the service provider is illegal & regarded as an offence. Any such practice will void any warranty & item will not be accepted for return or refund.

We don’t have to offer a refund

We don’t have to refund a customer if they: knew an item was faulty when they bought it damaged an item by trying to repair it themselves or getting someone else to do it (though they may still have the right to a repair, replacement or partial refund) no longer want an item (e.g. because it’s the wrong size or colour) unless they bought it without seeing it

Repairs & replacements

If a customer has ‘accepted’ an item, but later discovers a fault, we may have to repair or replace it. The customer can still reject the item after it’s been repaired or replaced.

A customer has accepted an item if they’ve:

told us they’ve accepted it (having had enough opportunity to inspect the item before confirming they’ve received it) altered the item, We must repair or replace an item if a customer returns it within 6 months – unless we can prove it wasn’t faulty when they bought it. We can ask a customer to prove an item was faulty when they bought it if they ask for a repair or replacement after 6 months.

Return Postage

Customer is responsible for return postage cost.

Warranties & guarantees

A customer has the same right to free repairs or a replacement regardless of whether they have a warranty or guarantee or not. So we may still have to repair or replace goods for 12 months from date of sale even if a customer’s warranty or guarantee has run out.

Proof of purchase

We can ask the customer for proof that they bought an item from us. This could be a sales receipt or other evidence such as a bank statement or packaging.

Items returned by someone other than the buyer

We only have to accept returns from the person who bought the item.

Disclaimer of Liability

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law madgadgettech.co.uk  & its suppliers, content providers & advertisers hereby expressly exclude all conditions, warranties & other terms which might otherwise be implied by statute, common law or the law of equity & shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods & services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites & any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.
